A Madison County, TN jury returned a $1.2 million award for a Bailey & Greer client who was injured in a collision with a Short Fuse Trucking vehicle

The Case Against Short Fuse Trucking

On February 15, 2014, the plaintiff was in the sleeping berth of his tractor-trailer. A Short Fuse Trucking driver was on I-40, which had construction projects ongoing. There were multiple signs warning drivers that the right lane of I-40 would be closed off due to this construction. The Short Fuse driver became distracted and stopped looking at the road. When he looked back, he realized that the traffic in the left lane had stopped, and that even by swerving, he would not be able to avoid impact with the plaintiff’s truck. At this time, another driver was behind the wheel of the plaintiff’s truck.

The impact of the truck accident was severe enough that the plaintiff, who was not wearing his safety harness at the time, was thrown from his bunk and onto the floor. The plaintiff denied medical attention at the time of the crash, and continued to work as a driver until, nine days later, he sought medical attention for his pain. He received worker’s compensation under the Texas system for four weeks, before he returned to work – not because he was no longer in pain, but because he could not afford to live unless he worked.

Four weeks after going back to work, the plaintiff returned to his doctor, who ordered an MRI and discovered the plaintiff has several herniated discs and a degenerative condition. The plaintiff now needs surgery to correct the condition, but has so far forgone the procedure because he cannot afford to take the time off of work, nor could be sure he could survive if the procedure rendered him unable to work permanently.

At trial, Short Fuse tried to argue that, because the plaintiff’s injuries proceeded the crash, they were not responsible for any additional damage that was caused. They also claimed that they should not be held responsible because the plaintiff was not wearing his safety harness while he was in the bunk. The jury disagreed, and awarded the plaintiff $1.2 million in damage. However, they did find that, by not wearing his safety harness, the plaintiff was 20% at-fault for his injuries. Under Tennessee’s comparative negligence laws, the award will be reduced by 20%.
